Terms and Conditions

1. Scope

The following terms and conditions apply to all orders through our online shop by consumers and entrepreneurs.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.

These terms and conditions also apply to future business relationships with entrepreneurs without us having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby objected to; they will only become part of the contract if we have expressly agreed to them.

2. Contracting Parties, Conclusion of Contract

The purchase contract is concluded with Paprcuts GmbH, Managing Director: Nils Wagner.
By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.

3. Language of the contract, storage of the contract text

The languages available for concluding the contract are German and English.
We store the contract text and send you the order data and our terms and conditions by email. For security reasons, the contract text is no longer accessible via the internet.


4. Delivery conditions
In addition to the stated product prices, shipping costs may apply. Further details on any applicable shipping costs can be found in the offers.
We only deliver by shipping. Unfortunately, self-collection of the goods is not possible.
 
5. Payment

The following payment methods are generally available in our shop:

Credit card
By placing the order, you simultaneously transmit your credit card data to us.
After your identification as the rightful cardholder, we immediately request your credit card company to initiate the payment transaction after the order. The payment transaction is automatically carried out by the credit card company and your card is charged.


PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, identify yourself with your login data, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction.
The payment transaction will be automatically carried out immediately afterwards by PayPal. Further information is provided during the ordering process.
 
Sofort
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. To pay the invoice amount via Sofort, you must have an online banking account enabled for participation in Sofort with PIN/TAN procedure, identify yourself accordingly, and confirm the payment instruction to us. Further information is provided during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

Klarna Invoice
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm,
Sweden, we offer you the option to pay by invoice. 
Please note that Klarna invoice is only available for consumers and
that the payment must be made to Klarna. 
When purchasing on invoice with Klarna, you always receive the goods first and you
always have a payment term of 14 days.

Apple Pay
To pay with Apple Pay, you must be registered with Apple and have activated the "Apple Pay" function. After selecting the payment method, please enter your Apple account login details to authenticate yourself. Then please confirm the payment instruction for the payment with a payment method you have stored (credit card or debit card) to us. The payment is carried out immediately after placing the order.
Google Pay
To pay with Google Pay, you must be registered with Google Pay. After selecting the Google Pay payment method, please enter your login details and confirm the payment with a payment method you have stored (credit card or debit card). The transaction is carried out immediately after placing the order. The payment data you have stored with Google Pay is not transferred to us.

6. Retention of title

The goods remain our property until full payment is made.
For entrepreneurs, the following applies additionally: We reserve ownership of the goods until full payment of all claims from an ongoing business relationship. You may resell the reserved goods in the ordinary course of business; all claims arising from this resale are assigned by you to us in the amount of the invoice value in advance – regardless of any connection or mixing of the reserved goods with a new item – and we accept this assignment. You remain authorized to collect the claims; however, we may also collect the claims ourselves if you do not meet your payment obligations.

7. Transport damages

For consumers, the following applies:
If goods are delivered with obvious transport damage, please report such defects to the carrier immediately and contact us without delay. Failure to report or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.
For entrepreneurs, the following applies:
The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the carrier, freight forwarder, or other person or institution designated to carry out the shipment. Among merchants, the inspection and notification obligations regulated in § 377 HGB apply. If you fail to give the notification regulated there, the goods are deemed approved unless it is a defect that was not recognizable during the inspection. This does not apply if we have fraudulently concealed a defect.

8. Warranty and Guarantees

The statutory warranty law applies. Information on any additional warranties and their exact conditions can be found with the product and on special information pages in the online shop.

9. Liability

We are always fully liable for claims due to damages caused by us, our legal representatives, or vicarious agents
  • in case of injury to life, body, or health,
  • in case of intentional or grossly negligent breach of duty,
  • in case of warranty promises, if agreed, or
  • as far as the scope of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on which the contracting party may regularly rely (cardinal obligations), due to slight negligence by us, our legal representatives, or vicarious agents, liability is limited in amount to the foreseeable damage at the time of contract conclusion, which typically must be expected to occur. Otherwise, claims for damages are excluded.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here https://ec.europa.eu/consumers/odr/. Consumers have the option to use this platform to resolve their disputes.
To settle disputes arising from a contractual relationship with a consumer or about whether such a contractual relationship exists at all, we are obliged to participate in dispute resolution proceedings before a consumer arbitration board. The responsible body is the General Consumer Arbitration Board of the Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in dispute resolution proceedings before this body.

11. Final Provisions

If you are an entrepreneur, German law applies to the exclusion of the UN Sales Convention.
If you are a merchant within the meaning of the Commercial Code, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
